By creating an account, accessing, or using API - Keshtay L.C. (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
To operate the Service we collect and process the following categories of information:
We use collected data to provide and improve the Service, process payments, enforce usage limits and tiers, detect and prevent abuse, respond to support requests, and send account-related notices (including usage alerts). Aggregated and anonymized analytics may be used for product improvements.

All payments are processed by Stripe and are subject to Stripe's terms. Refunds, charges, and disputes are handled via Stripe and follow Stripe's operational procedures. See our Refund Policy for details.
We may modify these Terms or pricing for the Service. For material changes to the Terms or to tier pricing that affect existing paid customers, we will provide at least 30 days' prior notice via the email address on file and/or through the Service. Continued use of the Service after the effective date of changes constitutes acceptance of those changes.
Tier features and pricing may be adjusted from time to time. We will notify affected customers at least 30 days before any pricing increase or change to included tier limits. For subscription renewals, changes announced with prior notice will apply on the next billing cycle unless otherwise specified in a commercial agreement.
Each tier has usage limits. Exceeding your tier limits may result in throttling, temporary suspension of access, or overage charges as documented in your plan. We will make reasonable efforts to notify you when you approach or exceed limits according to your notification preferences.
Either you or we may terminate the account per these Terms. Upon termination we may delete or anonymize account data in accordance with our data retention policies, except where retention is required by law or for legitimate business purposes (e.g. tax records, completed transactions).
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Keshtay L.C., API - Keshtay L.C., AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA OR DATA USE, ARISING OUT OF OR IN CONNECTION WITH USE OF THE SERVICE.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, EXCEPT WHERE APPLICABLE LAW OTHERWISE REQUIRES.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, OR COMPLETELY SECURE.
You are responsible for complying with applicable laws and export controls when using the Service. Prohibited uses include illegal activities, attempts to circumvent rate limits, abuse, and unauthorized access.
These Terms are governed by the laws applicable to Keshtay L.C. as specified in commercial agreements or, absent that, the laws of the State of New Mexico, United States. Disputes will be handled as described in any applicable commercial agreement.
We may modify, suspend, or discontinue features or the Service (in whole or in part) at any time. We will use reasonable efforts to notify affected customers of significant changes, and paid customers will receive advance notice for changes that materially impact service delivery.

These Terms constitute the entire agreement between you and Keshtay L.C. regarding use of the Service and supersede prior agreements. If any provision is held invalid, the remaining provisions remain in full force and effect.
